1) The first test of memory is the only test of memory in which the memory signal can be diagnostic. This is diagnostic of guilt or innocence. Also, in many cases, the often-overlooked first test provides evidence of innocence for the same suspects who are later identified with higher degrees of confidence on subsequent tests of a witness’ memory.

2) The logic underlying the Independent Source Doctrine is contrary to scientific research.
